Estate planning ensures that your assets pass in accordance with your wishes. It allows you to be the person in charge of the plan and makes it so much easier for your family members. You decide who gets your assets and who should be the executor of your estate.
A typical estate plan includes a Last Will and Testament, Statutory Durable Power of Attorney, Medical Power of Attorney and HIPAA Release. However, if you want privacy, own out-of-state property, or hope to avoid probate you may consider a living trust. If your estate is large, you may need a family limited partnership or gifting plan to benefit from the annual gift tax exclusion. If you have a disabled family member, you may need a Special Needs Trust.
